1. Acceptance of the Terms
These Terms of Use are entered into by and between you and HobbyWaves ("HobbyWaves", "we", "us", or "our"). These Terms, together with any documents they expressly incorporate by reference, govern your access to and use of hobbywaves.com and any related subdomains, newsletters, applications, and services (collectively, the "Sites"), whether as a guest or a registered user.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify HobbyWaves immediately of any unauthorized access to or use of your account.
5. Editorial Nature of Content
HobbyWaves is a news and commentary publication focused on the collectibles, trading cards, comics, video games, memorabilia, and related hobby industries. Much of the content on the Sites is factual reporting; some content is opinion, commentary, analysis, reviews, or speculation. Opinion pieces are the views of their authors and do not necessarily reflect the views of HobbyWaves as an organization.
We exercise editorial judgment in selecting, editing, and presenting content. We strive for accuracy, but the news and market information we publish is time-sensitive and may change after publication. Nothing on the Sites constitutes professional investment, financial, legal, or tax advice. 6. Intellectual Property Rights
The Sites and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HobbyWaves, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on our Sites, except as generally and ordinarily permitted through the Sites according to these Terms or with our prior written permission.
7. Fair Use & Third-Party Content
HobbyWaves may quote, reference, embed, or reproduce limited portions of third-party content — including images, logos, press releases, social media posts, and public statements — for purposes of news reporting, commentary, criticism, education, and public interest journalism. We believe such use constitutes fair use under U.S. copyright law and similar doctrines in other jurisdictions.
Third-party trademarks, service marks, product names, and logos appearing on the Sites are the property of their respective owners. Their appearance does not imply affiliation, endorsement, or sponsorship unless explicitly stated. We use such marks solely for identification and editorial purposes.

8. Trademarks
The HobbyWaves name, the HobbyWaves logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HobbyWaves or its affiliates. You must not use such marks without the prior written permission of HobbyWaves. All other names, logos, product and service names, designs, and slogans on the Sites are the trademarks of their respective owners.
9. Prohibited Uses
You may use the Sites only for lawful purposes and in accordance with these Terms. You agree not to use the Sites:
- In any way that violates any applicable federal, state, local, or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To send, receive, upload, download, or reuse any material that does not comply with the Content Standards set forth in these Terms.
- To impersonate or attempt to impersonate HobbyWaves, a HobbyWaves employee, another user, or any other person or entity.
- To scrape, spider, data-mine, or otherwise collect data from the Sites using automated means without our prior written consent.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Sites.
- To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Sites, the server on which the Sites are stored, or any server, computer, or database connected to the Sites.
10. User Contributions
The Sites may contain comment sections, forums, tip lines, and other interactive features that allow users to post, submit, publish, display, or transmit content or materials ("User Contributions"). All User Contributions must comply with the Content Standards below.
By providing any User Contribution on the Sites, you grant us and our affiliates a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, perform, display, distribute, and otherwise disclose such material for any purpose. You represent and warrant that you own or control all rights in and to the User Contributions and that all User Contributions comply with these Terms.
Content Standards. User Contributions must not:
- Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
- Be likely to deceive any person or promote any illegal activity.
- Impersonate any person or misrepresent your identity or affiliation with any person or organization.
- Contain private or confidential information about any person without their consent.
11. Monitoring & Enforcement
We have the right, but not the obligation, to remove or refuse to post any User Contributions for any or no reason in our sole discretion, and to take any action we deem necessary or appropriate if we believe any User Contribution violates these Terms, infringes any intellectual property right or other right of any person, or is otherwise objectionable. We may disclose User Contributions or account information to law enforcement or other third parties when required or advisable.
12. Copyright Infringement (DMCA)
If you believe that any User Contributions or other material on the Sites violate your copyright, please send a written notice of claimed infringement to our designated agent at hello@hobbywaves.com.
Your notice must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and where it is located on the Sites.
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
It is the policy of HobbyWaves to terminate the user accounts of repeat infringers in appropriate circumstances.
13. Takedown Requests & Corrections
We take accuracy and good-faith reporting seriously. If you believe content on the Sites is inaccurate, defamatory, invasive of privacy, or otherwise unlawful, you may request a correction or removal by contacting us at hello@hobbywaves.com or through our corrections page.
Please include: (1) the URL of the content, (2) a clear explanation of the concern, (3) any supporting documentation, and (4) your contact information. We will review requests promptly and respond in accordance with applicable law and our editorial standards. We reserve the right to decline requests that we determine, in our sole discretion, are not well-founded or would compromise legitimate editorial content.

14. Reliance on Information

We reserve the right to withdraw linking permission without notice.

HobbyWaves is based in the United States. We make no claims that the Sites or any of their content is accessible or appropriate outside of the United States. Access to the Sites may not be legal by certain persons or in certain countries. If you access the Sites from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
18. Disclaimer of Warranties
The Sites, their content, and any services or items obtained through the Sites are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Neither HobbyWaves nor any person associated with HobbyWaves makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Sites.
19. Limitation of Liability
To the fullest extent provided by law, in no event will HobbyWaves, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use of, or inability to use, the Sites, including any direct, indirect, special, incidental, consequential, or punitive damages, even if advised of the possibility of such damages.
20. Indemnification
You agree to defend, indemnify, and hold harmless HobbyWaves, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your User Contributions, or your use of the Sites.
21. Governing Law & Jurisdiction
All matters relating to the Sites and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule. You irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any legal action arising out of or relating to these Terms or the Sites.
22. Arbitration & Class Waiver
At HobbyWaves's sole discretion, it may require you to submit any disputes arising from these Terms or your use of the Sites, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Delaware law.
You agree that any arbitration or proceeding shall be limited to the dispute between HobbyWaves and you individually. To the fullest extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class-action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. You waive any right to a jury trial in any action arising out of or relating to these Terms or the Sites.
23. Waiver & Severability
No waiver by HobbyWaves of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
24. Force Majeure
HobbyWaves will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond HobbyWaves's reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, shortages of transportation, facilities, fuel, energy, labor, or materials, or failures of telecommunications or internet service providers.
25. Assignment
We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any purported assignment in violation of this section is void.
26. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and HobbyWaves regarding the Sites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Sites.
